• RIGHTS AND REPRODUCTIONS POLICY
     

    Ben Uri Gallery and Museum is proud to share images of works of art in the public domain, and our archives, for educational and non-commercial uses and to increase accessibility for students, scholars, artists, and art lovers in their studies, creative projects, and artistic expressions. 

    Ben Uri Gallery and Museum does not require researchers to request permission to publish material that is in the public domain or for which we do not own the copyright; we respect the intellectual property rights held by artists, their estates, and other rights holders. We do ask that researchers identify and cite specific artwork information when publishing images held by Ben Uri Gallery and Museum. It is the responsibility of the requester to identify the copyright holder, obtain necessary permissions, and comply with all copyright provisions. Ben Uri Gallery and Museum can provide high-resolution TIFs for reproduction, publication, and study, by request and following the provided terms below.

  • WARNING CONCERNING COPYRIGHT RESTRICTIONS

    The copyright law of the United Kingdom governs the making of photocopies or other reproductions of copyrighted materials. Under certain conditions specified in the law, libraries and archives are authorized to furnish a photocopy or other reproduction. One of these specified conditions is that the photocopy or reproduction is "not to be used for any purpose other than private study, scholarship, or research." If a user makes a request for, or later uses, a photocopy or reproduction for purposes in excess of "fair use," that user may be liable for copyright infringement.

     

    Other tools exist for researching copyright, include the WATCH File (Writers, Artists, and their Copyright Holders) which is maintained in the UK by the University of Reading here.

     

    Other reference points include The Artists Collecting Society (artistcollectingsociety.org) and the Design and Artist Copyright Society (dacs.org.uk) who both maintains lists of the artists they represent and are authorised to grant permission on behalf of artists. 

     

    Ben Uri Gallery and Museum welcomes information about copyright pertaining to artwork in its collections. Some rights information may be reflected in the online collections catalogue. If you have rights-related information or believe that the catalog does not accurately and fully display applicable restrictions, please email collections@benuri.org.

  • REPRODUCING IMAGES OF THE BEN URI GALLERY AND MUSEUM COLLECTION
     

    Ben Uri Gallery and Museum supports the fair use provision of UK copyright law. Ben Uri is committed to supporting scholarly research and its dissemination through various forms of publication and outreach. While Ben Uri Gallery and Museum owns, or is the custodian of, the physical objects in its collections, we may not own the intellectual content or copyright, trademark, or other related interests. 

    The responsibility remains with the requester for determining whether any such intellectual property rights, including moral rights, exist; obtaining all necessary permissions; and guarding against the infringement of those rights that may be held elsewhere. If the content in question is under copyright, appropriate permissions must be sought from the owner of the rights. 

     

    When using images given by Ben Uri Gallery and Museum or of any of our collections, you should not suggest or imply that Ben Uri endorses, approves of, or participated in your projects. Ben Uri and its operating programs should not be used in the title of your project or in any way that may confuse consumers to believe that we were affiliated with or sponsored your project. If in doubt please email collections@benuri.org with full details.

  • CREDITING AND CITING BEN URI GALLERY AND MUSEUM

    For the benefit of future researchers, we ask that requesters using reproductions of our works give appropriate credit when reproducing an image of Ben Uri Gallery and Museum collections. If an image does not appear in the catalog record, there may be a legal rights restriction that disallows us to make that content available, there is no digital reproduction that is appropriate for online display, or there is a copyright interest in the digital image of the work. All image credit lines should read “Courtesy of the Ben Uri Collection, London"  Please refer to individual object records in benuricollection.org.uk for full institutional credit line and specific detail for the works of art.

     

    To assist in developing the collection, please inform Ben Uri Gallery and Museum, by email initially to collections@benuri.org, if you are planning to publish a work of art in our collection in a scholarly publication or exhibition catalog so we may add it to our bibliographic references. While there is no obligation or requirement, we would appreciate a gratis copy of any publication in which the images are reproduced to accession into The Ben Uri Library.   • REQUESTING IMAGES

    Please verify that the works you are interested in are held in the Ben Uri collection by searching benuricollection.org.uk. To initiate an image fulfilment request, please email to collections@benuri.org. Requests for works of art that are in the public domain or images that have no copyright restrictions will be usually be processed under normal circumstances within 3 business days. Please allow for a longer processing time for works or images under copyright or if new photography is requested.
